BYLAWS

ARTICLE I

SECTION I-NAME AND PURPOSE

NAME: The name of this unit is the Longview Detachment #959, Marine Corps League, Inc., Chartered on August 16, 1996. It is a subsidiary organization of the National Marine Corps League, is a not for profit organization incorporated with the Texas Secretary of State and is a subsidiary organization of the National Marine Corps League, an organization incorporated by an Act of the 75th Congress of the United States of America approved on August 4, 1937.

PURPOSE: The purposes of the detachment shall be those listed in the charter of the National Organization.

SECTION II-LOCATION
The principle location shall be at the Longview Detachment Headquarters, located at 1512 Alpine Rd. Longview, Texas, unless redirected by the Commandant of the Longview Detachment, Department of Texas MCL.

SECTION I11-MEETINGS

Detachment meetings shall take place on the 4th Tuesday of each month, except during December meeting. The December meeting will be decided during the November meeting. All detachment officers must be notified about all detachment meetings.

ARTICLE II

SECTION I-OFFICERS

OFFICERS: a. The Detachment must elect a Commandant, a Senior Vice Commandant, a Junior Vice Commandant and a Judge Advocate. The Detachment Commandant will appoint a Chaplain, Sergeant-At-Arms, Adjutant, Paymaster or an Adjutant/Paymaster. Installation of Officers report shall be forwarded to Department Adjutant/Paymaster.
b. A member may serve in only one elected office at any one time. However, a member serving in an elected office may at the same time serve in an appointed office, ie, the same member may serve the office of Adjutant/Paymaster.
c. The elected officers of the Detachment shall be its Board of Trustees.

APPOINTMENTS: The Commandant shall appoint such committee chairpersons and unit representatives as required for the smooth operation of the detachment.

SECTION II-ELECTIONS AND INSTALLATION OF OFFICERS

ELECTION OF OFFICERS: Election of officers shall take place at the regular scheduled meeting as last part of business during the month of February.

INSTALLATION OF OFFICERS: Installation of officers to be conducted at the regular scheduled meeting in March.

SECTION III-ASSUMPTION OF TERM OF OFFICE, QUORUM AND DUTIES

TERM OF OFFICE: Newly elected officers shall take office at the installation ceremony. The term of office for the newly elected officers is one year and may stand for reelection.

TERMINATION: All officers are required to notify the Commandant if unable to attend any scheduled meeting. Any Officer absent without good cause and approved by the Detachment Commandant from two (2) consecutive scheduled business meeting shall forfeit that office. The Detachment will elect a new officer for the vacated office, at the next scheduled business meeting.

QUORUM: A quorum shall consist of three (3) elected/appointed officers and fifteen (15) members present at each meeting.


ARTICLE III

SECTION I- AMENDMENTS AND EFFECTIVE DATE

AMENDMENTS: Detachment Bylaws may be amended at any regular meeting of the detachment by a two third (2/3) majority vote of the members present, provided the proposed revision, amendment or repeal is submitted in typewritten form to the Detachment Adjutant/Paymaster 10 days prior to a schedule regular business meeting where the proposed amendments will be presented to the membership. An amended article must pass approval of the Department Judge Advocate before coming effective. Notice of the proposed amendments shall be announced in a mail out to all members. Voting shall take place on the following monthly meeting. Each revision, amendment or repeal of a provision of the detachment bylaws which are approved at a regular meeting that does not have an effective date will become effective upon approval at the meeting at which it is approved.

ARTICLE IV
Section 1- Banking Transactions

Section 1 – Banking: All banking and or loan transactions must be presented to the detachment members at a regular business meeting. The Detachment Commandant, Sr. Vice Commandant or Detachment Paymaster has the authority to act on behalf of the Detachment, in reference to any and all banking or loan transactions that have been voted and approved by the detachment. The Detachment Paymaster has the authority to write checks for all regularly scheduled monthly bills and emergency expenses under $300. Two signatures are required for emergency expenses in excess of $300. All authorized check writers must be approved by the Detachment Commandant and the Detachment Paymaster. The financial records of the detachment may be audited by the detachment’s Board of Trustees following the installation of new officers each year. A record of such audit, indicating acceptance and/or exceptions by the newly Board of Trustees, shall be entered into the minutes of the detachment meeting for the month of March.

ARTICLE V
Section 1 – Committee Procedure

Section 1 – Committee: The chairperson of a committee is required to report to the Detachment Commandant with all recommendations. All Committee recommendations and suggestions must be approved by the Detachment Commandant.
Any Committee member absent from a scheduled meeting without good cause shall forfeit their seat on the committee. The Detachment Commandant can appoint another MCL member to fill the vacancy.

ARTICLE VI
SECTION 1- VIOLATIONS


Section 1 - Violations: It is a violation of detachment policy for a member to personally benefit at the expense of the League or to receive personal gain in any form, being either materialistic or monetarily.

DETACHMENT BYLAWS COMMITTEE CERTIFICATION: I, Milton Saxon, Judge Advocate of the Longview Detachment, Marine Corps League, do hereby certify these bylaws, as contained hereafter, were approved by two thirds (2/3) of the members present and voting at the regular monthly meeting at 1512 Alpine Rd., Longview, Texas on August 28, 2007.
